Federal court rules against Trump’s backup tariffs

A federal court ruled Thursday against President Donald Trump’s 10% global tariff on most U.S. imports. A panel of three judges for the Court of International Trade in New York found in a split ruling that Trump wrongly used a decades-old trade act to issue the tariffs. The tariffs were invalid and legally unauthorized, the majority wrote in the opinion. Trump imposed the tariffs in February after the Supreme Court found his previous, emergency tariffs unconstitutional.

The decision on Thursday directly blocked the latest tariffs for three plaintiffs who sued over them, including the state of Washington and two businesses. However, the court dismissed claims from 23 of the 24 plaintiff states, saying that they lacked standing.

What response did the ruling receive? The ruling was lauded as a major victory for American businesses and consumers by the Liberty Justice Center, which represented the two businesses. Burlap and Barrel imports spices to the U.S., while Basic Fun! is a toy company with licensing agreements with classic brands like Disney and Mattel.

The trade act that Trump relied on was a law passed for a specific historical crisis, and not to cause trade deficits, said Jeffrey Schwab, an attorney at Liberty Justice Center. Washington state Attorney General Nick Brown said the ruling opened the door for others to protest these tariffs in court.

Trump had yet to respond to the ruling as of Friday morning.

Meanwhile, the White House celebrated a favorable report from the Bureau of Labor Statistics. U.S. employers added 115,000 jobs in April, the second straight month of strong job growth, according to the agency.
