California accuses State Farm of mishandling LA fire claims
State investigators took legal action against the State Farm over allegations that the insurance giant delayed and underpaid on wildfire claims filed from the devastating 2025 Los Angeles fires. The California Department of Insurance’s investigation uncovered a documented pattern of illegal behavior and significant mismanagement of wildfire claims, according to a Monday statement.
Insurance Commissioner Ricardo Lara launched the investigation based on consumer complaints from survivors of the fires. Investigators followed the facts and found that State Farm delayed, underpaid, and pummeled policyholders in red tape after a life-altering tragedy, according to Lara. State Farm’s behavior was unacceptable, and the state aimed to hold them accountable, he added.
State Farm policyholders filed approximately 11,300 residential claims related to the Los Angeles wildfires, making up about one-third of the total residential wildfire claims filed across all providers, according to the commissioner’s office. Thousands of survivors’ claims may have been impacted by the violations flagged by state investigators, according to the statement.
How was the investigation conducted? State officials reviewed about 220 claims as a sample group and found nearly 400 state law violations in 114 of the sample claims. Investigators said State Farm failed to launch investigations within 15 days of the filing of a claim or offer definitive decisions on claims after more than a month. The state also found that the company failed to both pay out accepted claims or give written notice for additional time for payouts as legally required. Investigators also said they found unreasonably low settlement offers, confusion among adjusters assigned to claims, and overall poor communication with policyholders.
