Kagan doesn't shudder

We now know that Elena Kagan advised Justice Thurgood Marshall, for whom she worked, to vote for compulsory taxpayer funding of abortion on demand. We know that despite the Constitution's clear command---that no funds may be appropriated without consent of the House of Representatives---Kagan advised Marshall to defy the Constitution and force taxpayers to pay for a "procedure" that millions regard as homicide.

It must be remembered that the Supreme Court struck down the laws of all 50 states in its radical Roe v. Wade ruling in 1973. And the court only narrowly ruled (5-4) in Harris v. McCrae in 1980 that Congress could not be forced by court order to pay for abortions.

Nearly 20 years later, Kagan continued her pro-abortion militancy while serving Bill Clinton as a domestic policy adviser. It's now clear that Kagan intervened during negotiations in the Clinton White House on how to respond to the passage by Congress of a ban on partial-birth abortions.

Cathy Ruse, now with the Family Research Council, was a staff lawyer on the House Judiciary Committee in the late 1990s. That's when Congress passed and Clinton twice vetoed a ban on partial-birth abortion. Ruse helped the pro-life majority in Congress in its efforts to override Clinton's veto. Even many Democrats then wanted to stop this heinous act. Pro-abortion Sen. Daniel Patrick Moynihan recoiled at it, calling it "too close to infanticide."

Ruse has responded convincingly to the errors in William Saletan's online discussion of Kagan's role. All parties agree that Kagan was a key player in the Clinton administration at that time.

No member of the U.S. Senate should be in doubt what he or she will be voting for if confirming Elena Kagan to a lifetime appointment on the Supreme Court: She will be there for perhaps 40 years voting to force taxpayers to support abortion on demand---even the grisliest forms of abortion. The self-described "pro-choice" nurse thought nothing of the assignment. That is, until she witnessed a partial-birth abortion first-hand:

"I stood at the doctor's side and watched him perform a partial-birth abortion on a woman who was six months pregnant. The baby's heartbeat was clearly visible on the ultrasound screen. The doctor delivered the baby's body and arms, everything but his little head. The baby's body was moving. His little fingers were clasping together. He was kicking his feet. The doctor took a pair of scissors and inserted them into the back of the baby's head, and the baby's arms jerked out in a flinch, a startle reaction, like a baby does when he thinks that he might fall. Then the doctor opened the scissors up. Then he stuck the high-powered suction tube into the hole and sucked the baby's brains out. Now the baby was completely limp. I never went back to the clinic. But I am still haunted by the face of that little boy. It was the most perfect, angelic face I have ever seen."

Even the very liberal Washington Post columnist Richard Cohen wrote in 2000 that he "shuddered" at the thought of partial-birth abortion. He recommended that his fellow liberals join with pro-life conservatives to stop this horrific practice. He said, powerfully, that he shudders at the people who don't shudder at partial-birth abortion.

Well, Elena Kagan doesn't shudder. She is zealous for this most inhuman and bloody practice. And she will, if she has the power, make you pay for it, too.
