Man who killed a BLM protester sentenced to 25 years

A Texas judge on Wednesday sentenced U.S. Army Sergeant Daniel Perry to 25 years in prison for killing Black Lives Matter protester Garrett Foster in 2020. Perry, 36, said he shot Foster in self-defense when 28-year-old Foster pointed a rifle at him. Both Perry and Foster were white. Perry said he was dropping off a rideshare customer near a demonstration in Austin, Texas, at the time of the shooting. Prosecutors said Perry wrote violent, racist texts and social media messages before the shooting.

Will his lawyers appeal? Perry’s lawyers said they will appeal his conviction. The Texas Board of Pardons and Paroles is also reviewing Perry’s case for a possible pardon. District Attorney Jose Garza plans to present a case against a pardon. Texas Gov. Greg Abbott has said he would sign a pardon recommendation as soon as it hits his desk.
