Former Marine on trial for New York subway chokehold death
Jury selection began on Monday in former U.S. Marine Daniel Penny’s trial for the death of Jordan Neely. Penny faces charges of second-degree manslaughter and criminally negligent homicide. He has pleaded not guilty and denied wrongdoing. Last year he even asked a judge to dismiss the charges. The judge ultimately denied that motion.
What all happened? Neely entered a subway car in Manhattan in May 2023 and began making verbal threats to passengers, according to the office of Manhattan District Attorney Alvin L. Bragg, Jr. Penny was also on the train. After Neely made the threats, Penny approached Neely from behind and put him in a chokehold, prosecutors said. The chokehold continued for several minutes in total, including after Neely stopped moving, according to Bragg’s office. Neely was declared dead after being taken to a hospital.
